Need some advice and you guys know your stuff.

I have a 25 acp colt that has the back end of the frame blowed??? off. For purposes of discussion, lets conclude it absolutely cannot be fired or fixed.

Can I sell/ship it to a guy that does not have an FFL?

The frame IS the gun. If it is in fact non-repairable it's no different than the many assault rifle kits that have been sold as parts sets with a destroyed receiver. You should be able to ship it to someone without an FFL provided no local law disallows this.

Well Rob, I know what you mean. But I have called ATF on other questions ... and that's why I'm here. That personal stuff you'll have to work out on your own ... like the rest of us.

There are specific conditions that signify a non functioning firearm. What you describe as the rear end of the frame blown off may or may not meet the BATFE criteria. beetr to ask them what they consider non functioning and non repairable.

If they consider it repairable (forget cost factors) it would still be a firearm.

Remember these are the guys that say you have a machine gun if the semi auto weapon you have can be be readily converted to a full auto weapon with 8 hours in a machine shop .
Do not go by your own opinion as to whats inert/deactivated etc.
then get the agents name etc for future reference.

it is still a hand gun the assault weapons comparison isnt correct because atf has rules on what is considered a destroyed reciever.i wouldnt take a chance.

If someone just wants the parts strip it and send all but the frame. If they want frame and all to hang on the wall cut the frame in half and cross your finger. We lose more and more rights in sidebars in the goverment that never make the news so keep tring to CYA

The frame as describe above is "not readily restorable to firing condition" as described if the back end is blown off. I'm having to use the machine gun receiver description here. Receivers used to be torch cut into 3 pieces and that met BATF criteria at one time ,their criteria being based upon the fact that siginificient metal was removed, the remainder was warped and the heat treat was now gone. I think that now most of the receiver has to be scrapped.
I've never heard the 8 hours in a machine shop cited above before but I bet most shops could make a reciever from scratch in that time.
I guess If someone wanted to err on the side of extreme caution here they could just pitch the receiver, which is now junk anyway, and ship the rest of the parts. However I still think this would be considered a destroyed receiver in it's current condition.

I can tell you one thing - don't try mailing the President a pistol, even if it's one that looks real but you made out of chocolate for his birthday.

Remember the one off German Luger in 45ACP. Two guns cut in half then welded back together makeing a wider frame. I sure the BATF could build some neat guns just to prove your frame is serviceable
