Joe,
I think you hit on the problem, I had my 16 gauge French guild gun apart and the top lever was connected inside to the locking lug by a small bolt. If that bolt ever failed the top lever would move around as if it had a broken top lever spring, but the bolt wouldn't retract. It shouldn't be hard to get to it by removing the stock, just a few small bolts and screws.
