Hi, I'm having a discussion with am individual I'm buying a gun from. He is saying that a firearm (talking shotgun here) can only be shipped from one FFL to another FFL, NOT from an individual who is not a FFL holder to the buyers FFL.

What I need is a reference from the ATF regs to back up my side of the discussion. I just can't find it on the ATF site.

If someone can post it that would be great!

Some States require that nonsense but the Feds don't.

Hi, this seller is from Alabama, so I kind of doubt that state requires such nonsense.

They don't. The National Association of Federally Licensed Firearms Dealers has been pimping for FFLs on both ends for 30 years.

The Feds allow a private individual to send a gun to an FFL holder, but in some cases the law is irrelevant. Some FFL holders simply will not accept a gun from other than an FFL holder. Depends on the dealer. Then there are state laws...

I sold a gun a few years ago to a fellow who had that happen, his FFL wouldn't accept a gun shipped to him by me. I told my buyer that his FFL was screwing with him and to find someone else. I also gave him the option to pay for the FFL on my end if he insisted on using his FFL. He found someone else, I shipped the gun and everything was good and best of all his original FFL screwed himself out of the transaction.

In my case this is what happened, I bought the gun all fine and good, asked for the total cost. The total he gave me was $75 more than the gun. I just made a comment that $75 was a bit steep for shipping & Insurance. The seller then said that the shipping & Insurance was $50, but his FFL is charging him $25 to handle the transfer. I told him that you don't need to go thru a FFL to send a gun to another FFL. Dead silence (I think he might be mad at me!). I sent the $$ he requested and let the issue drop.

Talked to a guy at work and he stated that you must send from one FFL to another, thus my question.

I sometimes wonder if some of these FFL's don't take advantage of a persons lack of knowledge.

Anyway, my friend at work now believes me.

A little knowledge is dangerous, especially when it is wrong. Many FFL dealers think that it must come from a dealer for them to be able to return it to the shipper it does not. Some believe that only dealer to dealer transfer is legal. Both are wrong. Some are lazy and some are uneducated or just dumb. Read the rules and follow then is very simple advice.
