The Guantanamo guests appear to have constitutional rights from what I read from googling "US constitutional rights and Guantanamo prisoners."
I can't remember details but didn't the Supreme Court rule the US government couldn't deprive them of habeas corpus even if they were offshore?

"On June 12, 2008 the United States Supreme Court ruled, in Boumediene v. Bush, that the Guantanamo detainees were entitled to the protection of the United States Constitution.[ Justice Anthony Kennedy, writing for the majority, described the CSR Tribunals as "inadequate", and wrote:
"The laws and Constitution are designed to survive, and remain in force, in extraordinary times."
Justice Kennedy was a Reagan nominee.

Which is why I believe we should have tried and executed ( if guilty) those found to have violated the rules of war and held the rest until the peace, anotherwords never let them go. They declared war on us, once you let loose the dogs of war cry havoc and understand that the cost are everything. I never believed the Bush policy of treating them outside the classic rules for conflict held water. The result has been a loose of the moral high ground. Cheney and Co were wrong. I don't doubt their intent was good, but they pushed the envelope in ways we should not have. Prosecute the criminal terrorist yes. Military tribunals yes. Permanent detention until the cessation of hostilities (effective life without parole) yes. Had the administration not hybridized some new status, we would be cleaner now.

I admire you for your courageous honesty.... That and a dime used to get someone a cup of coffee. What value could there possibly be in courageous honesty, or any issue driven debate, if demographics is at or near the top of the importance list? My favorite rule of war is FBI miranda warnings for enemy combatants in the middle east. One interesting tidbit might be that the recidivism rate when emptying out Guatanamo may be a bit better than when calif. prisons are purged of the best of the best. The bad guys can't be who they are, but are always seen as a political opportunity.

Then why are the Guantanamo detainees still where they are? Because they are enemy combatants and there is probable cause to hold them.
But what about the constitutional right to speedy trial? Won't work because they are non citizens and not on US soil...Geo

Craig, some may think the move towards early release of non-violent criminals is solely political, but both right and left are concerned with the skyrocketing costs of incarceration and the burden on state budgets. A few years ago Texas, hardly the bastion of liberal thinking regarding criminal justice, moved towards more intensive probation supervision of non-violent felons rather than incarceration. The cost savings was about 1/4th to 1/5th of what it would cost for imprisonment. From what I recall reading about the movement, recidivism rates were surprisingly lower. Gil

Courage and honesty rarely reside together in public discourse but Canada hasn't fallen that far nor has the United States.
A presidential aspirant elevated by millions for "telling it like it is" yesterday said his opponent is the biggest liar in the world and Americans the highest taxed in the world!
Old colonel's sincerity without apology or regret represents majority America from my experience of the country from worst to the best.
Demographics insulted and lied to share the same respect for honesty and courage and will show their appreciation for it in November.
There is no democracy without honesty and courage. Don't discount it.
