Gay marriage? I still hold that the "right" to gay marriage is a manufacture of the liberal courts similar to the strained construction of abortion as a constitutionally protected right under Life Liberty and Pursuit of Happiness. Gay marriage and abortion prohibition were the law of the land long before the courts transformed both into rights.

Shoot, I remember when both were not only illegal and a sin, but a disgrace as well...Geo

Geo, the SC opinion also railed against the motivation of the Texas legislature as the facts that were brought out about the conditions of the closed clinics and the necessity of having admitting privileges did not match up at all with the justifications propounded by the legislature. Breyer almost called the whole lot liars. FYI, even if you feel that the right to an abortion was a creation of liberal justices, that right was nonetheless in existence a long time before TRAP became the favored way to smite out abortions.
