Not trying to "read' into any regulations. I've made three inquirys to the BATF about transfer of firearms on my C & R and all three times all they were concerned about was "is the firearm in question over 50 yrs old", all it had to do was meet one requirement. It all up to the seller if he want to accept the C & R for transfer. Well respected arms dealer in the northeast Joe Salter transfers mauser 98 actions on C & R, stated on his web site. Not trying to start a pissing match but there seems to be some gray areas.

Speaking of Lawyers 1878. I was not trying to fan the flame. I just want to know the legal definition of original condition, missing parts should not matter if what is present is in original condition, original chambering etc. When I have a question I just call the ATF they are very helpful. I have received the same answer as RJH on this subject. I did enjoy your snide and snotty comments in your original post. I do live in Montana. I am a fourth generation Montanan and did not move here to skip out on taxes. After what happened in 2008 I was under the assumption people never applied any financial rules; just found ways to evade them.

Wow, when I mentioned "I'd see if there is any interest" I wasn't expecting quite what happened. smile

For now I think I'll withdraw it. Some folks have asked via PMs about certain parts so I may go that route or try selling it elsewhere.

Please feel free to continue any discussion on the legal aspects of transferring it. I do find it interesting. My own reason for wanting an FFL holder is that both receivers and firearms are mentioned in ATF ruling 85-10, which discusses importation of military C&R firearms. It states that a receiver is not a C&R item while an original firearm can be. For this reason, and what I am attempting to sell more closely resembles a receiver than a firearm I go in that direction. I'm not saying that my interpetation is right or wrong, that's just the way I see it.

Thank You, it's nice to have an "internet expert" to do the "interpertation" for me but I'm still going to contact BATF, as Lochlan said they are very helpful.
